This website, dncvcb-xu.myshopify.com (the "Site"), is operated by Ascendyx LLC ("Sirvella", "we", "us"). By visiting the Site or purchasing from us, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Site.

1. Incorporated Policies

Our Refund & Return Policy, Shipping Policy and Privacy Policy are part of these Terms and are incorporated by reference. These policies are available on every page of the Site and at checkout. By completing a purchase you confirm that you have read and accepted them.

2. Products, Descriptions & Pricing

We make every effort to display our products, colors and descriptions accurately. Slight variations in color may occur due to screen settings and product batches; such variations are not defects. All prices are in US Dollars. We reserve the right to correct pricing or listing errors, to change prices, and to cancel and refund any order affected by an obvious error, even after an order confirmation has been sent. Promotional discounts apply as displayed at checkout and cannot be applied retroactively.

3. Orders, Acceptance & Refusal

Your order is an offer to purchase. We reserve the right to accept, limit or refuse any order at our sole discretion, including orders that appear to be placed by resellers, orders with mismatched billing information, orders flagged by our fraud-prevention systems, and orders to addresses with a history of payment disputes. If we cancel an order, we will refund the full amount paid.

4. Chargebacks & Payment Disputes

You agree to contact us at support@sirvella.com and give us 7 business days to resolve any issue before initiating a chargeback or payment dispute. We respond to every support request. Chargebacks filed in violation of this section, including disputes on orders with confirmed delivery to the address provided at checkout, will be contested with complete transaction evidence (order data, AVS/CVV results, policy disclosure at checkout, delivery confirmation and support correspondence). We reserve the right to recover costs and fees resulting from illegitimate chargebacks, to report friendly fraud to relevant fraud-prevention networks, and to refuse future orders from customers who have filed illegitimate disputes.

5. Shipping & Risk of Loss

Shipping is governed by our Shipping Policy. Risk of loss passes to you upon the carrier's confirmed delivery to the address provided at checkout. Optional Shipping Protection is available at checkout and covers loss, theft and damage in transit as described in the Shipping Policy.

6. Warranties & Disclaimer

Products are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, beyond the product descriptions on the Site, including implied warranties of merchantability and fitness for a particular purpose. Nothing in these Terms limits rights that cannot be limited under applicable law, including remedies for defective products under our Refund & Return Policy.

7. Limitation of Liability

To the fullest extent permitted by law, the total liability of Ascendyx LLC arising out of or related to any order is limited to the amount you paid for that order. We are not liable for indirect, incidental, special or consequential damages, including delays outside our control.

8. Intellectual Property

All content on the Site, including text, images, graphics and layout, is the property of Ascendyx LLC or its licensors and may not be copied or used without prior written permission.

9. Governing Law

These Terms and any dispute arising out of your use of the Site or any purchase are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law principles and excluding the United Nations Convention on Contracts for the International Sale of Goods.

10. Binding Arbitration & Class Action Waiver

Any dispute that cannot be resolved through our support team shall be resolved by binding individual arbitration administered by a recognized arbitration provider under its consumer rules, rather than in court, except that either party may bring an individual claim in small claims court. You and Ascendyx LLC each waive the right to a jury trial and the right to participate in a class action. Disputes must be brought in the party's individual capacity only. You may opt out of this arbitration provision by emailing support@sirvella.com within 30 days of your first purchase.

11. Changes to These Terms

We may update these Terms at any time. The version published on the Site at the time of your order applies to that order. Continued use of the Site after changes constitutes acceptance.
